General

All obligations of the Homesite Lease Agreement must be fully complied with and no violations of the Homesite Lease Agreement shall exist. 

All utility charges, and taxes (including jeopardy tax) shall be clear and the lease account with the owner shall be paid in full.

APPENDIX C - MANUFACTURED HOME COMMUNITY RULES AND REGULATIONS

The manufactured home Community ("Community") shall be subject to the following Rules and Regulations ("Rules") enacted by Jensen's, Inc. ("Owner") which shall be binding upon the Resident and all residents of the Community. The signing of a lease agreement by the Resident shall signify his acceptance of these Rules, together with any amendments thereof or additions thereto adopted in compliance with applicable law, and shall further signify Resident's understanding that any contemplated change, addition or the like to the exterior or interior of the home or affecting the homesite shall, as provided below, be first submitted in writing to Owner for its approval.

I. Buildings and Appurtances; Maintenance 

A. Manufactured Homes ("Homes")

1. All homes shall be maintained in safe and sanitary condition and free of insects, rodents, vermin, pests and the like. The homes shall be kept level and in good repair and shall rest firmly on their concrete piers. Their exteriors shall be clean, neat and properly painted at all times. Any change in the exterior color of a home or appurtenant structures including, without limitation, additions, utility buildings, porches, fences, steps and skirts must be approved in writing by the Owner prior to the change being made. The Owner reserves the right to require reasonable repair, maintenance and improvement of any home or its setting.

2. All utility and sewage lines, pipes, connections, fixtures, wiring, systems, and the like which are Resident's responsibility, shall be properly connected, insulated and protected before a Resident takes occupancy, and shall be maintained in good order and repair by the Resident. Each home shall be equipped with a heating system other than a system requiring a fuel oil tank. The installation of a new fuel oil tank is expressly prohibited.

3. Plumbing is to be kept in good repair and plumbing leaks are to be repaired immediately. The Community Owner reserves the right to shut off the water supply to a home if a water leak exists whenever such action is deemed by the Community Owner to be in the best interest of the Community.

4. If a home is substantially damaged by fire, windstorm or other cause, the resident shall repair or remove the damaged home within reasonable time or the community Owner may do so at the resident's expense. Any home substantially damaged shall be secured within 24 hours of said damage. If the resident elects to repair his damaged home, such repairs shall begin as soon as practicable after the damage has occurred. All loose damage and debris shall be removed immediately. Damage visible on the exterior of a home shall be repaired within fifteen (15) days from date of damage. If the damage cannot be repaired with fifteen (15) days, the Community Owner may require that the home be removed from the community for repair.

5. Street numbers shall be properly posted on all homes with 3-inch numbers.

6. Additions

(a) An addition to a Home, which addition may include, but is not limited to, any modification or change in the structure of walls, floors or roof of the Home is permitted so long as such addition conforms to the local building codes, is approved by the appropriate local authority and provided that a written request, together with plans, is submitted to and written authorization is given by the Owner prior to the start of construction.

(b) Construction materials shall be the same as those used in the construction of the home.

(c) The addition shall be of a design in harmony with the Home which it serves and be constructed in a craftsman-like manner. The addition shall be kept in good condition and repair at all times.

(d) All construction authorized under this Paragraph shall be commenced within 90 days of approval by the Owner and shall be completed within 30 days of such commencement.

B. Utility Buildings

1. One utility building for each Home is permitted so long as such building conforms to local building code, is approved by the appropriate local authority, approved (in writing) by Owner and meets the following specifications:

(a) Wood-framed Utility Buildings

i. Such Buildings shall not exceed exterior dimensions of 12'x12'. The size and shape of the homesite may be considered when determining size of utility building to be installed.

ii. All roofs shall be pitched and shall not exceed 10' in height at the center and 8' at the sides. It shall have a least two surfaces which meet at an angle to permit water to run off in at least two directions.

iii. Construction materials shall consist of:

(a) Walls - siding shall be aluminum or vinyl lap, matching the home.

(b) Roof - exterior plywood covered with asphalt matching the house.

(c) In no case will used lumber and/or tar paper be permitted for exterior surfaces.

2. A utility building shall be of a design in harmony with the home which it serves, be constructed in a craftsman-like manner and be painted or stained to blend with the Home. The building shall be kept in good condition and repair at all times. No new or newly acquired utility building shall be less than 8'x'8'. Local management must approve proper location on homesite.

C. Porches

A porch is permitted so long as it conforms to the local building code, is approved by the appropriate local authority and is authorized in writing by the Community Owner. A porch may be enclosed if written authorization is given by the Community Owner. Construction materials shall consist of only aluminum and glass. Porches and railings shall be kept in good repair and painted in harmony with the color of the home.

D. Carports and Garages

1. Carports and garages will only be permitted on an individual basis and written permission must be obtained from the Owner. Carport or garage approval will be at the sole discretion of the Owner.

2. A plan showing location, materials and dimensions shall be submitted with each proposal.

3. Only pre-finished aluminum (for carports) or materials matching the home (for carports and garages) shall be used and shall be constructed and anchored in a manner to withstand local weather conditions.

4. An attached carport or garage may not be structurally dependent upon the home or any other addition to the home.

II. Maintenance of Site on which Home is located ("Site")

A. Lawns, Trees and Shrubbery

1. Resident shall keep grass mowed, trimmed and free of weeds, if applicable.

2. Grass and weeds shall be removed from around trees and shrubbery and mulched accordingly, if applicable. Residents desiring gardens in excess of one hundred (100) square feet shall obtain written permission from the Community Owner. All gardens shall be kept neat and well cared for including removal of grass and weeds. If garden is not in use it must be restored to lawn at Resident's expense.

3. Residents may not remove trees or otherwise alter landscaping of the homesite without the written permission of the Owner.

4. Should a Resident fail to comply with the above standards, Community Owner may perform the work or contract for the work to be done and bill the Resident for reasonable services rendered.

B. Driveways, Walks, Driveway Lights and Mail Boxes

1. Resident shall keep driveway free of oil and/or other stains, clean, and in good condition and repair. Resident shall be responsible for resealing driveway if necessary.

2. Walks, patio, driveway lights and mailboxes shall be kept neat and in good condition and repair by the Residents.

3. Residents shall remove ice and snow from driveways, walk and patios.

C. Fences, Steps, Skirts and Bulkheads

1. Fences, not in excess of twenty-six inches (26"), are permitted if properly erected and maintained.

2. Fences, steps and skirts shall be kept neat and in good repair.

3. Steps to the homes, porches or patios shall be constructed of sturdy precast concrete or shall be of pressure treated wood or aluminum construction or acceptable mortared brick. Concrete blocks are not acceptable.

4. Porches, skirting and screening are the property of the Resident. However, if left on the homesite at the time of moving, they shall become the property of the Community Owner.

5. Foundation siding, new skirting, or skirting being completely replaced, shall be of acceptable mortared bricks with proper vents installed at least every 12'. Approved vinyl or prefinished aluminum, installed vertically with a two track system, with vent panels and shall be of a color harmonious with the color of the home, may also be used.

6. No bulkheads or retaining walls shall be installed without a detailed plan being approved by the Owner.

D. Rubbish and Junk

1. Rubbish, trash and properly wrapped garbage are to be deposited only in appropriate closed receptacles which shall be covered at all times and kept in designated areas.

2. Trash containers shall be moved to the street for collection only on collection day, then

returned to designated areas on that day. (Designated areas shall be: (1)behind the home and (2)not visible from the street.) Trash shall not be left for collection in plastic bags alone unless required or requested by trash collector.

3. Abandoned, unused or rusting material, or other types of junk, shall not be permitted on any site. Replacement appliances and building materials shall be removed from the Community by Resident.

4. Owner and Resident acknowledge that the local governmental authority may participate in a mandatory recycling program and Resident agrees, by execution of this Homesite Lease Agreement, to comply with the recycling requirements as established by the local governmental authority.

E. Clothes Line and Reels

1. Clotheslines are not permitted outside of homes.

2. One (1) umbrella type clothes reel is permitted. Community Owner shall be consulted for proper location.

III. Motor Vehicles 

A. Automobiles

1. Only passenger cars in good repair and appearance shall be kept in the Community. A maximum of two (2) vehicles for each home is allowed, unless approved by Owner and additional approved parking areas are constructed. The term "passenger vehicle" shall include only properly registered automobiles and Vz ton or smaller pick-up trucks or vans properly registered with passenger or combination plates.

2. Unregistered or junk vehicles shall not be permitted in the community. Such vehicles shall be towed away at the Resident's expense.

3. Vehicles shall not be repaired in the Community.

4. Damage to the paved parking areas caused by leaking gas or oil from vehicles shall be the responsibility of the resident.

5. Posted speed limits, stop signs and other traffic controls shall be obeyed by all motor . vehicles.

B. Golf Carts

1. Golf Carts are permitted provided they are kept in good condition and acceptable appearance. They will be operated in a safe manner following normal rules of the road. The Resident will be responsible for any action with his Golf Cart. Drivers under 16 years of age not permitted.

C. Commercial and Recreational Vehicles - Boats

1. Commercial and Recreational vehicles including trailers, motor scooters, boats, motorcycles, motorbikes, ski mobiles, motorized go-carts and boats of any kind, are not permitted to be kept in the Community. Except that recreational vehicles may be kept in designated parking areas if available while space permits.

2. Residents' campers may be brought in for purposes of loading or unloading only for a period of two days per trip.

D. Parking

1. Vehicles shall be parked overnight in the driveway of the home to which they pertain. Vehicles shall not be parked on lawns, overnight in streets or roadways, or in other unauthorized places. Vehicles so parked in such unauthorized places may be towed at the Resident's expense.

IV. Children and Guests

The conduct of visiting children and guests shall be the responsibility of the resident.

V. Occupancy Limitations

1. Total occupancy shall not exceed three (3) persons, one of who shall be a named

Resident and must be at least fifty-five (55) years of age. No resident shall be under the age of forty (40).

2. Persons living in Community more than fifteen (15) consecutive days, or more than thirty (30) days during the year, are classified as Residents, not guests, and may be subject to Resident rules.

VI. Pets 

A. Size and Control

1. Only small, quiet, normally domesticated cats or dogs, as determined by Owner in its sole discretion, shall be permitted, and then only with prior written consent of the Owner.

2. All pets shall be kept on a leash and under control at all times and shall not be permitted to make unnecessary noise or create unnecessary disturbances. Pet owners are responsible for cleaning up after their pets at all times.

3. Pets of visitors shall be the responsibility of the resident.

4. Pets, which create a disturbance or unpleasantness, shall, at the request of the community Owner, be removed from the Community.

5. No more than one pet per home permitted.

6. Resident shall submit written request to the main office and secure written permission from the Owner prior to acquiring a pet to be brought into the Community.

B. Wild Animals

1. Residents or Guests shall not feed water fowl or wild animals.

VII. Signs

A. Types allowed

1. No commercial signs of any type are allowed in the Community. This includes: Tag sales, yard sales, vehicle sales, etc.

2. "For Sale" signs are permitted subject to the conditions below (Section B). 

B. "For Sale" Signs

1. "For Sale" signs of reasonable size (not to exceed 216 square inches) and quality, representing bona fide offers to sell homes, are permitted in the Community subject to the conditions as set forth below. A maximum of two (2) signs per home.

2. The Resident shall be in compliance with all items under Appendix B (Resale Standards) and shall obtain written permission from the Owner prior to posting a "For Sale" sign and shall be re-registered every thirty (30) days thereafter.

3. Such signs shall be posted only in windows or doors of the home and in such a manner as not to unreasonably detract from the appearance of the Community.

4. "For Sale" signs shall be removed within twenty-four (24) hours of the time when a home is no longer offered for sale.

VIII. Noise and Lights 

A. Personal Conduct

1. Residents of the Community and their guests shall conduct themselves in a reasonably

quiet manner so as not to disturb others.

2. Noise levels shall be reduced after 10 P.M. for the benefit of all Residents.

3. Residents shall be responsible for the conduct of their guests.

B. Motor Vehicles

1. Vehicles of Community Residents shall have properly maintained muffler systems.

2. Vehicle engines shall not be unnecessarily raced or gunned at any time. 

C. Air Conditioning Equipment

1. Air conditioning equipment shall be properly maintained so that it is not disturbing to neighbors.

D. Exterior Lights

1. Exterior lights shall not be of intensity or angle of focus to disturb others. 

E. Satellite Dishes (MSD)/Antennas

Mini Satellite Dishes (MSD) are permitted provided the following rules are adhered to:

1. A written request for installation must be made with the desired location indicated and written permission granted by Jensen's prior to installation.

2. No MSD larger than one meter (+39") in diameter are permitted.

3. MSD's may be installed on the side or roof of a house, a wooden utility building or another suitable location as approved by the local authority. A Dish may be installed to a height NO higher than if the actual unit was installed on the peak of the house roof. The overall height may be no higher than 50" above the roof peak. The location must be approved by the appropriate local authority and be as inconspicuous as possible.

4. All MSD's must be installed to the manufacturers' specifications, and any permits required by the town or county must be obtained by the Resident. If a Resident requests trimming or tree removal to accommodate a MSD, we will trim or remove trees only if we would do so under standard parameters. We will not trim or remove trees solely to accommodate a MSD.

5. Special antennas such as Ham Radio antennas may be permitted on a case-by-case basis with the prior written approval of the appropriate company officer.

IX. Enforcement

1. No change in the exterior color of a home or other building in the Community shall be made without the prior written consent of the Community Owner and no construction or placing of any home or other buildings or of any exterior addition to the home or any such other building in the Community shall take place without such consent. Anyone seeking such consent shall submit a description of the proposed change or construction, including adequate plans and specifications where applicable, and the Community Owner shall review such description with regard to harmony of exterior architectural design, attractiveness, and location in relation to surrounding structures and topography, and shall respond in writing to the resident seeking such consent within fourteen (14) days of its receipt of such description.

2. Any violation of a provision of this Section which is not corrected within thirty (30) days of the delivery in hand or deposit in the mail by registered or certified letter with return receipt requested of notice of such violation from the Community Owner to the resident shall entitle the Community Owner to commence summary ejectment proceedings after sixty (60) of such day's delivery or mailing.

In addition to its rights set forth above, the Community Owner may require as a precondition to leasing a homesite within the Community that the resident repair, change or modify any home, other building, or any addition to any home or other building, which in the discretion of the Community Owner, does not comply with the above standards.

X. Waiver

The Community Owner retains the right, in its sole discretion, to waive, in writing, any one or more of these rules with respect to any one or more residents. Waiver of any rule or right shall not be deemed a waiver of any other rule or right unless expressly stated therein, nor shall a waiver on behalf of any specified individual or individuals be deemed a waiver for any unspecified individuals.

XI. Amendments

Amendments to the regulations may be made at any time by the Community Owner, and copies of such amendments shall be distributed to Community Residents. Such amendments shall become effective thirty (30) days after notice is given to Community Residents.

XII. Miscellaneous

1. Each Resident shall, in connection with the use, maintenance or repair of his home and the leased homesite, comply with all governmental rules, regulations and/or ordinances.

2. The sewer and/or septic system (as applicable) are to be used for normal domestic use only and no Resident shall abuse or overload such system.

3. The water and/or well system (as applicable) shall be used for personal household consumption by Resident(s) only.

4. Due to the presence of underground cables and wires, no Resident shall dig or excavate (including the planting of any bush, tree or garden) on any portion of the homesite, without the Owner's prior written permission and calling the local underground utility locator service.

5. No Resident shall operate or permit the operation of a business in such Resident's home.

6. Tag sales are expressly prohibited in the community unless authorized in writing by the Owner.

7. Resident shall provide and maintain liability insurance upon Resident's manufactured home and any contractor hired or retained by Resident to perform any work or repairs for which Owner's permission is required pursuant to the terms of their Homesite Lease Agreement and any appendices thereto shall maintain insurance to protect against liability arising from such work ii or repairs. Upon request by Owner, Resident shall provide Owner with proof of any insurance requested pursuant to the provisions of this paragraph.

8. Excessive display of lawn ornaments is expressly prohibited. ,

9. Resident is solely responsible for the clean up and damage from any fuel oil spillage or overflow.
